26.2 Foundation | Waiver and Agreement
Application: 2025 Team Inspire
Event: 2025 TCS Sydney Marathon, presented by Asics
In consideration of my accepting this entry to the 2025 TCS Sydney Marathon, presented by Asics (“EVENT”), I hereby for myself, my heirs, executors and administrator, waive and release any and all rights for claims and damages I may have against and its employees, volunteers, representatives, agents, consultants including the 26.2 Foundation and any coaches and consultants and product sponsors for any and all injuries suffered or sustained by me in said EVENT and in the training and planning sessions for said EVENT or travel to and from any of the preceding. I further attest and certify that I am physically fit and have sufficiently trained for competition in this event and a licensed medical doctor has verified my physical condition.
I grant permission for use of my name and/or photograph or voice in broadcast, telecast, print or any other account of this event and agree to waive any compensation for such use.
Application: I have received the 26.2 Foundation application via the Grassrootz platform and understand all the terms and conditions of my participation in the 2025 program. I am confirming the information submitted in the application is accurate. I have also noted the due date for material submission and fundraising commitments. I understand that the submission of this application does not guarantee me a spot on the team.
Fundraising Commitment: I agree to collect a minimum of $3,500 for the 26.2 Foundation by August 31, 2025. If I have not reached the amount in donations by that date, I will personally be responsible for the balance owed. I fully understand that unless I cancel before officially registering for the EVENT, the 26.2 Foundation, will charge my credit card.
Cancellation Policy: I understand I may cancel my participation on the team and fundraising commitment before officially registering for the 2025 Sydney Marathon. There are no refunds of any acquired donations. After registering for the event, there are no cancellations and fundraising commitments must be adhered to. To cancel, you must contact Kimberly Chisholm, Executive Director via email at kim.chisholm@26-2.org.
After registering I understand I am fully responsible for raising the minimum of $3.500 even if, for any reason including injury or illness I am unable to run in the 2025 Sydney Marathon. If I cancel participation after this date, your credit card will be charged the balance of your fundraising commitment. The 26.2 Foundation has your consent to do this.
There are no refunds in event you can’t run due to injury etc., also no refunds in event that the marathon itself is canceled, delayed or rescheduled for any reason.
In the situation of a runner who defaults on this agreement and their credit card is not valid for any reason, the 26.2 Foundation reserves the right to pursue collection of the debt and the applicant will be fully responsible for any and all legal fees incurred by with this collection process. Credit card information will be collected upon set up of a personal fundraising page through Grassrootz, the online donation platform
There are no refunds on any funds raised or deferrals to 2026 Sydney Marathon in the event that the race is cancelled.
*Donations raised and received by the 26.2 Foundation will not be refunded under any circumstance even in the event of the 2025 Sydney Marathon being cancelled.
Matching Gift Policy: Many companies match employees’ charitable contributions. Applicants can check with their employer to see if their company has this program and ask donors if their employer has matching gifts.
*Matching gifts DO NOT apply to the fundraising minimum but are considered over and above the minimum. It is the responsibility of the applicant to contact the company to provide all matching gift information and ensure that the gift is processed.
Please review the waiver and agreement set forth in the above-mentioned contract. No applicant will be considered without agreeing to the contract in this application.
I agree and acknowledge that (i) participating in the EVENT is a potentially hazardous activity that could result in injury or death, (ii) I am participating in the EVENT in the exercise of my own free will and at my own personal risk, and (iii) it is my responsibility to understand the risks and determine whether I am fit to safely complete the EVENT and to understand and determine the precautions I should take to do so. I hereby attest and certify that my physical condition and ability to safely complete the EVENT have been verified by a licensed medical doctor (except where the latter is in violation of my religious principles) and that I am physically fit and have sufficiently trained to complete the EVENT.
I attest that I have read the rules of the EVENT, including the terms in this waiver, and agree to abide by them. I assume all risks to me associated with completing the EVENT, including, but not limited to: falls, contact with other pedestrians, the effects of the weather, including high heat and/or humidity, traffic and the conditions of the road or trail, all such risks being known or unknown and appreciated by me when participating in the EVENT.
I hereby release the 26.2 Foundation, and its members, directors, officers, employees, representatives, agents, successors and assigns from any and all present and future claims for any loss, injury, illness (including COVID-19), damage (including real or personal property damage) or liability sustained by me while participating in the EVENT, whether resulting from negligence, inherent risk of sport or exercise or otherwise, and I hereby waive the right to bring any such claims against the 26.2 Foundation and members, directors, officers, employees, representatives, agents, successors and assigns.
I further agree to indemnify and hold harmless the 26.2 Foundation and its members, directors, officers, employees, representatives, agents, successors and assigns from and against any and all claims arising from my involvement in the EVENT or incidental thereto, wherever, whenever, and however the claims may arise, including, but not limited to, travel to and from the EVENT.
I assume all the foregoing risks and accept personal responsibility for any damages and loss following any loss of property, injury, illness (including COVID-19), permanent disability, or death resulting from my participation in the EVENT.
I have read and fully understand the above waiver, release, and assumption of risk and fully understand that I have given up substantial rights by signing this waiver, release, and assumption of risk, and sign it voluntarily.
I agree that any legal claim or dispute arising out of, or in any way relating to my participation in the EVENT, shall be governed by the laws of the Commonwealth of Massachusetts, USA, and will be adjudicated exclusively by and in, and I hereby submit to the exclusive jurisdiction of, the federal and state courts located in Boston, Massachusetts, USA.
By checking the consent box on the application, you agree that you are signing this voluntarily. You declare that you have exercised your own judgment in signing this agreement and you further declare that the decision to sign this agreement is your own.
